Chemical Exposure & Poisoning

Hydrogen Sulfide Poisoning - Toxic Exposure Injuries

Hydrogen sulfide is a colorless, toxic, and flammable by-product of decomposition. It is an issue in maritime law because this gas can build up in fishing vessels where fish waste storage is improperly ventilated. When the gas cannot escape, it accumulates to poisonous and toxic levels. In heavy concentrations, such as in small or enclosed spaces, it renders a victim unconscious and can result in death very quickly.

Hydrogen sulfide poisoning is often evidence of an unseaworthy vessel

Vessel owners and operators who allow the accumulation of this hazardous substance can be held liable for operating an unseaworthy ship. Under the Jones Act, employers are responsible for providing seamen and other workers with a safe place to live and work. Failing to ventilate areas where fish waste accumulates is a clear violation of this provision of the law.

Exposure is often fatal or permanently disabling

Seamen who survive exposure to hydrogen sulfide can be left with ongoing pulmonary edema. This can be fatal after some time elapses and usually leaves the victim unable to work even if they do live. Those who do not survive often die from airway obstruction caused by a failure of the central nervous system. In some cases, coworkers trying to rescue victims also succumb. In any case, the victims or their families need compensation to accommodate the disability or death that resulted from exposure to this toxin.
