What Employment Rights Are Available To Fishermen Who Have Been Affected By Covid-19?
Covid-19 has impacted the entire fishing industry from limited trips to low-price on catch. Unfortunately, fishermen are exposed to Covid-19 on fishing vessels and contracting the virus. If a fisherman contracted Covid-19 during the course of his employment, under the law an employer is responsible to pay the fisherman’s entire medical treatment related to the virus, called “cure”.
Additionally, the fisherman’s employer during the time the fisherman is recovering from the virus must pay a daily stipend called “maintenance” for the fisherman. If the employer and/or vessel owner failed to take proper measures and precautions to protect the fisherman from contracting Covid-19, additional damages may be available.
Questions have also arisen regarding crew members who have gone home and weeks later is informed another crew member has Covid-19 and he must self-quarantine. Is the owner/employer responsible for lost wages while he waits it out, even if he doesn’t ever test positive?
